
On Monday, the Court of Cassation ruled that the result was invalid House of Representatives elections 2025 For the two individual seats in the Minya al-Qamh constituency, in which Muhammad Sami Ali al-Sayyid, known as Muhammad Shahda, and Khaled Abdul Rahman Abdullah, known as Khaled Mashhour, were declared the winners of the first round, in a ruling that finally settled the legal controversy over the validity of their membership.
The ruling re-sheds light on the constitutional texts governing the issue of the validity of the membership of members of the House of Representatives, most notably Article (107) of the Egyptian Constitution, which states: “The Court of Cassation is competent to decide on the validity of the membership of members of the House of Representatives, and appeals are submitted to it within a period not exceeding thirty days from the date of announcing the final result of the election, and it decides on the appeal within sixty days from the date of its receipt. In the event of a ruling invalidating membership, it is invalidated from the date the Council is notified of the ruling.”
Under this constitutional text, the Court of Cassation is the only judicial body competent to decide on electoral appeals, and its rulings in this regard are final, final and enforceable, without the possibility of being appealed by any means of appeal.
In this context, Nazih al-Hakim, the cassation lawyer, confirmed that the ruling issued regarding the Minya al-Qamh district is considered a final and final ruling that cannot be appealed or reviewed in any way, stressing that any statements that imply that the National Elections Authority has the right to appeal the ruling or suspend its implementation represent a serious legal error and a clear violation of the provisions of the Constitution and the stability of the Court of Cassation’s judiciary.
Al-Hakim explained that the rulings of the Court of Cassation in electoral appeals are not appealable by their nature, and are not subject to any method of appeal, pointing out that the legal effect of the ruling takes effect immediately upon its issuance, obligating the competent authorities, led by the National Elections Authority and the House of Representatives, to implement it fully and without delay.
He pointed out that the ruling legally entails repeating the elections for the seats that were ruled invalid, in accordance with the procedures regulated by the law, ensuring respect for the constitution and the will of the voters, and preserving the integrity of the electoral process.
The ruling of the Court of Cassation in the Minya al-Qamh District is a direct application of the text of Article 107 of the Constitution, a consolidation of the principle of the rule of law, and an affirmation that the validity of parliamentary representation is subject to complete judicial oversight that does not accept circumvention or postponement.
