The Suez Criminal Court of Appeal ruled to reduce the sentence issued against a woman to 10 years in prison, after she had been sentenced to life imprisonment on charges of getting rid of her infant by throwing him next to one of the garbage bins in the governorate department.

The details of the incident go back to the security services in the Suez Security Directorate receiving a report stating that a dead infant had been found next to one of the garbage bins. Investigations were immediately intensified and the circumstances of the incident were examined, as the security services were able to identify the woman and arrest her, and upon confronting her, she admitted to committing the incident and getting rid of the infant after she had impregnated him.

The investigation authorities began their procedures, deciding to refer the accused to the Suez Criminal Court, which issued a life sentence, accusing her of premeditated murder.

During the hearing of the appeal, the defense team advanced several justifications, the most prominent of which was that the incident was not the result of prior planning or premeditated intent, but rather came about as a result of a moment, confirming the absence of the elements of premeditation and deliberation. It also indicated that the case papers lacked conclusive evidence proving the existence of intent to kill in the first place.

The defense added that the defendant’s social and psychological circumstances had a direct impact on her behavior at the time of the accident, demanding that the incident be re-described in light of these data.

After the case was deliberated, the Court of Appeal ruled to accept the appeal in form, and in the substance to amend the ruling issued, and merely punish the accused with 10 years’ imprisonment, instead of life imprisonment.
