The Minya Criminal Court of Appeals (Third Circuit), in its public session held under the chairmanship of Counselor Mohamed Diaa Abdel Zaher, and with the membership of Counselors Ahmed Esmat El-Zeini and Hussein Mustafa El-Gamal, ruled to accept the appeal submitted by the accused Mahmoud Talabah Mohamed Abdel-Ghani in form, and in the matter to amend the adjudicated sentence to aggravated imprisonment for a period of 3 years, while upholding the ruling otherwise, and requiring him to pay criminal expenses for both levels of litigation.

According to the case papers registered under No. 12228 of 2025, Minya Criminal Court, the Public Prosecution accused the accused and another who had previously been sentenced, of committing a premeditated murder without premeditation or premeditation against Nesma Ashour Hussein Ibrahim and Ali Talaat Fath al-Bab, in addition to the attempted murder of Hussein Ashour Hussein Ibrahim, Ashour Hussein Ibrahim, and Ahmed Saber Hussein Ibrahim.

The court stated, according to what was stated in the ruling, that the incident dates back to March 14, 2025, following an argument that broke out over the priority of traffic on the road between the first defendant and the brother of one of the victims, before the two defendants got into car No. (NMS 2358) and headed towards the victims and their families, where the collision occurred, which resulted – according to what was proven by the lawsuit papers, forensic reports, and medical reports – in the death of two people and the injury of others.

The court of first instance had ruled, during the session of October 26, 2025, to punish the accused, Mahmoud Talabah Muhammad Abdel-Ghani, with aggravated imprisonment for 7 years, with the confiscation of the car used in committing the incident, and obligating him to pay criminal expenses, while the civil case was referred to the competent civil court.

During the hearing of the appeal, the defendant’s defense maintained that the elements of the crime of premeditated murder were absent, and requested that the registration and description be amended to manslaughter. It also argued that the cases of necessity and legitimate defense were available. However, the court rejected these defenses, stressing its confidence in the evidentiary evidence on which the appealed ruling was based.

In the reasons for its ruling, the court concluded that the initial ruling adhered to the correct law and was based on reasonable evidence sufficient to support its ruling. However, it decided to use its authority to reduce the sentence in accordance with Article 417/3 of the Code of Criminal Procedure, and ended up amending the sentence to aggravated imprisonment for a period of 3 years while upholding the ruling otherwise.
